DUCK OFF ADVENTURES

Terms, Conditions & Privacy Policy

Applicable to: day hikes, micro-adventures, day activities, camping, overnight hikes, overnight escapes, mobility/Pilates-style sessions, outdoor cooking experiences, and associated transport and outdoor tasks.

1. Introduction

Duck Off Adventures (“we”, “us”, “our”) provides outdoor experiences across NSW, including day hikes, micro-adventures, camping trips, overnight hikes, overnight escapes, transport, outdoor cooking experiences, Pilates and mobility-style sessions.

By registering for or participating in any Duck Off Adventures activity, you acknowledge that you have read, understood, and agree to be bound by these Terms, Conditions, and Privacy Policy.

2. Eligibility

To participate in Duck Off Adventures events, individuals must:

  • Be 18 years or older unless the event specifies otherwise

  • Be physically capable of safely completing the activity

  • Complete our Wherewolf Waiver (including medical information) before attending

We reserve the right to refuse participation or remove any participant if eligibility requirements are not met or if safety is compromised.

3. Acknowledgement & Assumption of Risk

Our activities take place in natural environments and involve inherent risks, including but not limited to:

  • Slips, trips, falls, and uneven terrain

  • Exposure to changing weather and environmental conditions

  • Remote locations with limited access to medical support

  • Wildlife encounters

  • Fatigue, dehydration, and physical exertion

  • Transport in vehicles

  • Use of equipment such as hiking, camping, and cooking gear

By participating, you acknowledge these risks and voluntarily assume them. You understand that while reasonable care is taken, not all risks can be eliminated.

4. Fitness, Preparation & Participant Responsibilities

Participants are responsible for:

  • Ensuring their fitness level is suitable for the advertised activity

  • Bringing the required equipment and clothing

  • Following all instructions and safety directions from guides

  • Informing guides of illness, injury, hazards, or concerns

  • Not attending under the influence of drugs or alcohol

  • Acting respectfully towards others and the environment

  • Complying with Leave No Trace and applicable park/council rules

Duck Off Adventures may remove a participant if their behaviour, fitness, or preparedness poses a safety risk. No refunds will be issued in this circumstance.

5. Waiver of Liability

All participants must complete the Duck Off Adventures Risk Warning & Waiver of Liability through Wherewolf before attending any event.

To the maximum extent permitted by law, you agree that Duck Off Adventures, its owners, staff, guides, contractors, and volunteers are not liable for:

  • Injury, illness, or loss arising from inherent risks of outdoor activities

  • Injuries resulting from your own actions or failure to follow instructions

  • Injuries or losses caused by other participants

  • Environmental or natural conditions outside our control

  • Property damage or lost belongings

  • Delays, alterations, or cancellations caused by factors beyond our control

Nothing in these terms excludes liability where such exclusion is not permitted under Australian law.

Failure to complete the waiver may result in forfeiting your place without refund.

6. Payments, Refunds & Credits

Day Hikes, Day Activities & Micro-Adventures

  • Cancellations made 7 days or more before the event will receive a full refund, minus any third-party processing fees.

  • Cancellations within 7 days of the event are non-refundable.

  • Tickets may be transferred to another eligible participant before the event.

  • Credits may be offered at our discretion in special circumstances.

Overnight Hikes, Camping Trips & other journey based programs 

Unless otherwise specified, cancellations made 14–30 days before the event may be partially refundable, depending on agreements with suppliers.

  • Cancellations within 14 days of the event are non-refundable.

  • Tickets may be transferred to another eligible participant who meets fitness and eligibility requirements.

  • Credits may be considered for illness, injury, or exceptional circumstances at our discretion.

Escape Weekends

  • Unless otherwise specified, cancellations made more than 30 days before the event are fully refundable or can be transferred to another date.

  • Cancellations within 30 days of the event are non-refundable.

  • Tickets may be transferred to another eligible participant who meets the fitness and eligibility requirements.

  • Credits may be considered for illness, injury, or exceptional circumstances at our discretion.

Events Cancelled by Duck Off Adventures

If we cancel due to weather, safety concerns, guide illness, park closures, fire danger, or insufficient numbers, you will receive a full refund or a credit/transfer to a future event.

We are not responsible for additional expenses such as accommodation, travel, or equipment purchases.

7. Force Majeure

Duck Off Adventures is not liable for cancellations, delays, or changes caused by circumstances beyond our control, including severe weather, natural disasters, government restrictions, park or road closures, emergencies, or other unforeseeable events.

Refunds or credits in these circumstances will follow our refund policy.

8. Participant Conduct

All participants attending Duck Off Adventures events are expected to:

  • Act respectfully towards fellow participants, guides, and the public

  • Follow all instructions and safety directions given by Duck Off Adventures staff

  • Maintain behaviour that supports the safety and enjoyment of the group

  • Not consume drugs or alcohol during events

  • Refrain from any actions that may endanger themselves, others, or the environment

Duck Off Adventures reserves the right to remove any participant from an event if their behaviour is unsafe, disruptive, disrespectful, or negatively impacts the group. No refund will be provided if you are removed for misconduct.

9. Photography & Media

By attending Duck Off Adventures events, you consent to being photographed or filmed for marketing, promotional, and social media purposes.

If you prefer not to appear in any photos or videos, you must notify us in writing before the event at:

We will honour and respect your request.

10. Liability

Duck Off Adventures takes all reasonable precautions to provide safe, well-managed outdoor experiences. However, outdoor activities naturally involve inherent risks.

Duck Off Adventures does not accept responsibility for personal injury arising from these inherent risks, loss, theft, or damage to personal belongings, property damage, illness, or injury caused by environmental conditions, your own actions, failure to follow instructions, the actions of other participants, or natural conditions beyond our control.

By attending our events, you acknowledge and accept responsibility for your own safety, belongings, decisions, and wellbeing.

Nothing in this clause excludes liability where such exclusion is prohibited under Australian law.

11. Privacy Policy

Information We Collect

We collect information necessary for the safe and effective delivery of our events, including:

  • Name, date of birth, contact details

  • Emergency contact information

  • Medical conditions, allergies, medications

  • Fitness and experience information

  • Registration and payment details

  • Photos or videos taken during events

  • Incident reports and feedback

Data Storage & Security

Your information is securely stored using:

  • Wherewolf (encrypted waiver and data management system)

  • Google Forms (encrypted at rest and in transit)

  • Gmail (password protected with two-factor authentication)

  • Secure internal files accessible only by authorised staff

We take reasonable steps to protect your data from loss, misuse, and unauthorised access.

How We Use Your Information

We use personal information to:

  • Process event bookings and payments

  • Prepare for event logistics

  • Manage safety, risk, and emergency response

  • Communicate updates and reminders

  • Meet legal and insurance obligations

  • Improve our services and events

We do not sell or trade any personal information.

Sharing of Information

We may share limited information with:

  • Guides and contractors

  • Insurance providers

  • Emergency services (if required)

  • Trusted partners assisting with event delivery

All third parties are required to follow confidentiality and privacy obligations.

Data Retention

We retain participant information only for as long as necessary to meet operational, legal, and insurance requirements. Once information is no longer needed, it is securely deleted.
